These Terms of Service govern access to leparfait.us and purchases made directly from Le Parfait America Distribution, Inc., doing business as Le Parfait America. By using the site or placing an order, you agree to these Terms and the policies linked here. If you do not agree, do not use the site.

Eligibility and lawful use

You must be able to form a binding contract in your jurisdiction to make a purchase. You may not misuse the site, interfere with its security or operation, submit unlawful or deceptive content, violate another person's rights, or use the service for an unlawful purpose.

Products and product information

We make reasonable efforts to describe products, dimensions, capacities, colors, materials, availability, and prices accurately. Display settings and normal manufacturing variation may affect appearance. We may correct errors, update information, limit quantities, or cancel an affected order. If we cancel a paid order, we will issue the required refund.

Use products only for their intended purpose and follow current product instructions, tested recipes, food-safety guidance, and equipment instructions. Educational recipes and articles are general information and do not replace instructions specific to a product, recipe, medical condition, or regulator. Le Parfait America's current U.S. position does not represent its jars as approved or recommended for pressure canning unless and until a product-specific statement expressly says otherwise.

Orders, prices, and payment

An order is an offer to purchase. We may accept, decline, limit, or cancel an order for legitimate reasons, including availability, pricing or listing error, suspected fraud, resale activity, payment problems, or shipping restrictions. Prices, promotions, taxes, and shipping charges are shown at checkout and may change before an order is placed. You agree to provide accurate billing, shipping, and contact information.

Shipping, returns, and privacy

Our Shipping Policy, Return and Refund Policy, and Privacy Policy are incorporated into these Terms. If a subject is addressed by a specific policy, that policy controls for that subject. We will not duplicate operational promises here because duplicate text can become inconsistent.

Accounts

You are responsible for protecting account credentials and for activity under your account. Notify us promptly of suspected unauthorized use. We may suspend or close an account used unlawfully or in violation of these Terms.

Reviews and other submissions

You retain ownership of content you submit. You grant Le Parfait America a worldwide, nonexclusive, royalty-free license to host, reproduce, display, distribute, adapt for formatting, and use submitted content in connection with operating and promoting the business, subject to applicable law and our Privacy Policy. You represent that you have the necessary rights and that the content is honest, lawful, and does not infringe another person's rights.

We may moderate content for lawful reasons, including spam, fraud, harassment, privacy violations, irrelevance, or unlawful material. We do not suppress a genuine negative review merely because it is negative. Incentivized reviews must disclose the incentive, and no incentive is conditioned on positive sentiment.

Intellectual property

The site and its original text, graphics, photographs, trademarks, design, code, and other content are owned by or licensed to Le Parfait America and are protected by applicable law. Except for ordinary personal use of the site, no content may be copied, republished, sold, or commercially exploited without permission.

Third-party services and links

The site may use or link to third-party services. Their services and policies may apply separately. We are not responsible for third-party sites we do not control, but nothing in this section limits responsibility that cannot legally be limited.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the site is provided on an "as available" basis, and we disclaim warranties concerning uninterrupted or error-free site operation. Products remain subject to express warranties, implied warranties, and consumer rights that cannot lawfully be disclaimed.

To the fullest extent permitted by law, Le Parfait America will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the site. Nothing in these Terms excludes or limits liability or remedies that cannot legally be excluded or limited, including applicable product-liability and consumer-protection rights.

Indemnification

To the extent permitted by law, you agree to indemnify Le Parfait America against third-party claims arising from your unlawful misuse of the site, your infringement of another person's rights, or content you submit in violation of these Terms. This section does not apply to claims caused by Le Parfait America's own unlawful conduct.

Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules, except to the extent the law of your residence provides protections that cannot be waived. Subject to those nonwaivable rights, disputes must be brought in a court of competent jurisdiction serving DuPage County, Illinois.

These Terms do not require arbitration and do not contain a class-action waiver.

Changes, severability, and contact

We may update these Terms by posting a revised version and effective date. Changes apply prospectively unless law permits otherwise. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision is not a waiver.

Our operations, office, and warehouse are located at 910 S. Riverside Drive, Unit #7, Elmhurst, Illinois 60126. That warehouse may be designated as the return destination after authorization. Do not mail returns without prior routing instructions.
